SOCIAL SECURITY

The majority of our practice involves claims for Social Security disability benefits, Social Security Disability Insurance and/or Supplemental Security Income.

There is no fee for the initial consultation for Social Security claims. These cases are usually taken on a contingent fee basis: we will not charge a fee unless we obtain benefits for you. If your claim is approved, our office will generally charge a fee equal to 25% of the retroactive benefits you receive, but no more than $5,300.00, whichever amount is less.

Social Security has two disability programs:

(1) Social Security Disability Insurance (SSDI) also known as the Title II benefits; and

(2) Supplemental Security Income (SSI) also known as Title XVI benefits.

Both of the programs have the same medical requirements. One of the primary differences between SSDI and SSI benefits is that SSDI pays more than SSI benefits. This is because SSDI is limited to claimants who have worked approximately 5 out of the last 10 years. Social Security divides each year into 4 quarters and requires that a claimant show that he or she was employed and paid Social Security taxes for 20 of the last 40 quarters (5 out of the last 10 years). If someone is under 28 years of age, adjustments are made for the quarters needed.
